Airline — JSC "ALROSA Airlines".
Active Participant — A participant of the loyalty program who has accumulated at least 1 (One) Flight Segment within a year by flying regular flights of the Airline at fares that participate in Mile accrual.
"Diamond Mile" (also "Diamond Mile" Program, or Program) — A program implemented by JSC "ALROSA Airlines" for frequent flyers, according to which Miles are accrued to the Program Participant, which can be used to obtain tickets and other Awards in accordance with the Program Rules.
Bonus Miles — Miles that can only be used to obtain Awards and are not counted towards obtaining Silver, Gold, and Diamond status. Bonus Miles: 1. Welcome Miles, accrued to the Participant for registering in the Program. 2. Miles accrued under special offers and promotions of the Program.
Temporary Status — The initial status assigned to the Participant upon registration in the Program, allowing them to accumulate Miles and use the accrued Miles to obtain Awards.
Calendar year – a period of time from January 1 to December 31, lasting three hundred sixty-five or three hundred sixty-six (leap year) calendar days.
Participant Card (Card) — A virtual card of the "Diamond Mile" Program Participant, containing the Participant's surname, first name, information about the Personal Account number, and the Participant's status.
Booking Code — A letter designation of the seat quota on a flight corresponding to the purchased fare (RBD — reservation booking designator).
Miles — The accounting units of the "Diamond Mile" Program, accrued to the Participant and used by them in accordance with these Rules.
Password — A conditional word or set of characters set by the Participant independently during registration in the Program, used for authorization in the personal account on the Airline's website. The Program Participant should not disclose the password to third parties.
Personal Account (Participant's Account) — The account of the "Diamond Mile" Program Participant, where the Participant's personal data, accrued Miles, and Transaction history (accrual and redemption of Miles) are stored. The personal account number is indicated on the Card and in the Participant's personal account on the Airline's website. The personal account number is the Participant's identifier in the Program.
Flight Miles /Qualifying Miles - Miles accrued to a Member for flights on scheduled Airline flights, at fares participating in the accrual of Miles, and can be used to receive Awards under the Program, and are also taken into account for obtaining Elite statuses of the Program.
Flight Segment — A non-stop flight from the departure point to the destination point. In some cases, it includes an intermediate landing without changing the flight number.
Awards — An award ticket or other services that, in accordance with the "Diamond Mile" Program Rules, can be obtained by the Participant in exchange for redeeming Miles from the Personal Account.
Award Ticket — A ticket for any regular flight of the Airline, which can be obtained in exchange for redeeming a certain number of Miles from the Participant's Personal Account.
Privileges — Benefits, discounts, awards, and/or services provided on a permanent or temporary basis to the "Diamond Mile" Program Participants as a whole or differentiated depending on the Participant's status in the Program.
Code-share Flight — A flight operated under a code-share agreement between two airlines, according to which one party (Marketing Carrier) is entitled to sell transportation under its own carrier code on a flight operated by the other party (Operating Carrier). Each party enters the code-share flight into automated booking systems under its own number.
ALROSA Flights — Flights operated by Joint Stock Company "ALROSA Airlines".
ALROSA Website — www.aero.alrosa.ru
Program Website — The "Diamond Mile" section on the Airline's Website.
Program Service Center — The service department for the "Diamond Mile" Program Participants, where information about Participants is stored and processed, and where they can contact via email: Diamondmile@aero.alrosa.ru
Program Information Channels — The Program Website, electronic newsletters, and electronic account statements are the official communication channels of the Program. The rules of promotions, special rules concerning other periodically arising opportunities for Mile accrual and redemption, published in the Program information channels, are appendices and additions to these Rules.
Participant Status — The Participant's status reflects the degree of the Participant's activity in the "Diamond Mile" Program and the level of Privileges available as a result of this activity.
Status Miles — Miles that can only be used to obtain Awards and are not counted towards obtaining Elite statuses of the Program. Status Miles are accrued to Program Participants who hold Elite statuses when flying.
Transaction — The accrual or redemption of Miles from the Personal Account of the "Diamond Mile" Program Participant as a result of actions aimed at accumulating or using Miles to obtain Awards.
Participant — A person participating in the "Diamond Mile" Program, accepting and complying with these Rules.
Elite Statuses — Statuses granted to the Participant as a result of accumulating a sufficient number of Flight Miles or Flight Segments within 2 (two) years, as indicated on the Program website. Elite statuses allow Participants to accumulate additional Status Miles and receive Privileges when booking and using the Airline's services. The "Diamond Mile" Program has 3 (three) Elite statuses: "Silver", "Gold", and "Diamond".
1.1. These Rules and Conditions (hereinafter referred to as the Rules) govern the basic provisions and principles of operation of the Diamond Mile Program. Careful study of these Rules is the exclusive prerogative and responsibility of each Program Participant.
1.2. These Rules are effective from the moment of publication on the Airline's website. JSC ALROSA Airlines reserves the right to change the Loyalty Program Rules, including cancellation of the Program, both with and without prior notice, in the manner prescribed by these Rules and applicable law.
1.3. In order to ensure that each Participant is able to familiarize themselves with the changes to these Rules in a timely manner, the text of these Rules and amendments thereto are published on the Airline's website.
1.4. These Rules apply to all Program Participants without exception. Participation in the Program is a confirmation of proper familiarization and consent of the Participant with all provisions of these Rules in accordance with Art. 428 of the Civil Code of the Russian Federation.
1.5. These Rules replace all previous Rules concerning the Program and have unconditional priority over all previous public statements made by the Airline regarding the Program.
1.6. The Program may apply special and additional Rules set out in the Program documents and published on the Airline's website and in other information materials of the Program.
1.7. In the event of cancellation of the Program, premium airline tickets issued in accordance with the provisions of these Rules and issued before the date of cancellation of the Program may be used during their validity period.
1.8. Taking into account the provisions of paragraph 2.1.1. of these Rules, personal data of Participants related to participation in the Program are stored, processed and used for the purposes of the functioning of the Program.
2.1. General Provisions
2.1.1. Participation in the Program is individual. Any individual aged 14 (fourteen) years or older may become a Program Participant, taking into account the restrictions for minors established by the provisions of Articles 26, 27 and 28, Part 1 of the Civil Code of the Russian Federation.
2.1.2. To participate in the Program, you must register on the Airline's Website in the "Diamond Mile" section and receive a Personal Account number. Only one Personal Account is opened per Participant.
2.1.3. Participants of the Program are required to strictly comply with the Rules and Conditions of the Program, as well as meet all deadlines described in the Program. The Participant is required to familiarize themselves with the Rules of this Program, as well as with any changes that may be made to these Rules.
2.1.4. Only Participants who have provided all the necessary personal and contact information, including first name, last name and date of birth as recorded in a valid passport, have the right to request the accrual of Miles to their Personal Account and use the Miles accrued to their Personal Account to receive Awards. The Airline has the right to require the Participant to confirm the correctness of the personal and contact information provided.
2.1.5. By providing their personal data, the Participant agrees that the Airline has the right to use them to implement the Participant's interests within the framework of the Program. For the avoidance of doubt, the Participant is hereby notified that, as part of the necessary actions to implement the Program, the Airline processes the Participant's personal data provided by the latter upon registration in accordance with paragraph 2.2.2. of these Rules. These actions are carried out by the Airline in accordance with subparagraph 5 of paragraph 1 of Article 6 of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" (hereinafter referred to as Federal Law No. 152-FZ). The processing of the Participant's personal data in the context of these Rules shall mean any action (operation) or set of actions (operations) performed by the Airline with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, deletion of personal data.
2.1.6. The Participant agrees to the transfer of his personal data provided to the Airline upon registration to third parties - counterparties of the Airline (including in cases where such transfer constitutes a cross-border transfer of personal data in accordance with Article 12 of Federal Law No. 152-FZ), in cases where such transfer is necessary to implement the interests of the Participant within the framework of his participation in the Program, provided that such transfer and subsequent processing of personal data by the relevant third party will be carried out in accordance with the applicable legislation of the Russian Federation.
2.2. Registration in the Program
2.2.1. Registration as a Participant in the Program is free of charge. By registering in the Program, the Participant confirms their agreement with the terms of the Program.
2.2.2. Registration as a Participant in the Program is carried out in the following order:
1. Online registration on the Airline's website - by filling out an application in the "Diamond Mile" section and confirming the interested person's participation in the Program by clicking the virtual "Register" button. After this, the specified person is automatically assigned a Personal Account number, which is sent to the e-mail address specified by this person during registration.
2. The date of registration of the Participant in the Program is considered to be the date of assignment of the Personal Account number in the Program to the interested person. In this case, the Participant acquires all the rights provided for by the Program, and the Airline acquires the corresponding obligations in relation to the Participant.
3. After registration through the “Diamond Mile” section of the Airline’s website, the Participant receives a welcome 600 (Six Hundred) Bonus Miles, which are credited to his Personal Account.
2.2.3. The Participant uses the Personal Account number received at the time of registration, which gives the right to accrue Miles for flights on scheduled flights of the Airline.
2.3. Participant's Personal Account Number and Participant's Card
2.3.1. Each Participant of the Program can have only one Personal Account in the Program. The Personal Account Number is also the Participant's individual number in the Program.
2.3.2. If the Participant has more than one account in the Program, the accounts are subject to merger. The Airline reserves the right to merge Program accounts without prior notice to the Participant. When accounts are merged, miles are not added up and are not transferred to the Participant's final account. The priority account is the one with the most flight miles on its balance. In the event of the same number of flight miles on the accounts, the priority account is the one that was previously assigned based on the date of registration.
2.3.3. The Member's Account and the Miles recorded on it cannot be combined with the accounts and Miles of other Members of the Program or Members of other passenger rewards programs.
2.3.4. The Member's Personal Account Number is indicated on the Virtual Card in the Member's personal account on the Airline's Website.
2.3.5. Participants must indicate the Personal Account number when booking and checking in for scheduled flights of the Airline when using any services or Privileges provided under the Program. If the Card is not indicated by the Participant in the booking or at check-in, the services may be denied.
2.3.6. In case of any suspicion of unauthorized use of the Personal Account, the Participant must immediately notify the employees of the Program Service Center by e-mail: Diamondmile@aero.alrosa.ru, or notify the Airline Contact Center by phone number 8 800 500 50 95.
2.3.7. The Airline reserves the right to periodically send Participants a statement to the e-mail address specified in the Participant's profile, with information on the status of the Personal Account.
2.3.8. Information on the status of the Personal Account is available in real time in the Participant's personal account on the Program Website. To access the personal page and information, you must enter the Personal Account Number of the Program Participant and Password.
2.3.9. The Airline shall not be liable for the unavailability of information about the account status in the event that the Participant is unable to access the Airline's Website due to technical problems, the resolution of which does not directly depend on the Airline.
2.4. Password
2.4.1. The Password is required by the Participant for authorization in the "Diamond Mile" section on the Airline's Website, in order to receive information about the status of the Personal Account in the Program, to view and change personal contact information, enter information about unrecorded flights, issue Awards and perform other actions provided for by these Rules.
2.4.2. The Password is set automatically when the Participant registers in the Program.
2.4.3. The Participant can independently change their Password in their personal account on the Program Website.
2.4.4. The Participant must take all reasonable and necessary measures to exclude the possibility of unauthorized use of their Personal Account, in particular, to ensure the safety of the Password and the Participant Card and the inaccessibility of third parties to them.
2.4.5. The airline shall not be liable for damage caused as a result of unauthorized access by third parties to the Personal Account of the Program Participant using his/her Password.
2.5. Changing personal data
2.5.1. Each Participant is responsible for updating their personal data in a timely manner.
2.5.2. The Participant can independently change their personal contact information - telephone number, address - in their Personal Account, in the "Diamond Mile" section on the Airline's Website.
2.5.3. Changing the last name/first name, date of birth, passport details, email address is carried out only by the employees of the Program Service Center after receiving a written application from the Participant, including in electronic form by email, and cannot be done by the Participant independently on the Airline's Website. An application to change the last name/first name, passport details and email address must be accompanied by copies of supporting documents (marriage/divorce certificate, copy of a valid passport, etc.) or their scanned images if the Participant sends the relevant application by email.
3.1. General Provisions
3.1.1. Miles are the basic unit of calculation in the Program.
3.1.2. Miles are credited for paid and actually completed flights by the Participant on regular flights of the Airline.
3.1.3. To credit Miles to the Personal Account, the Participant must indicate their Personal Account number when booking and paying for an air ticket or service, or personally enter their Personal Account number when booking an air ticket or services on the Airline's Website. The Participant must ensure that the Personal Account number is recorded correctly and that the spelling of their first and last name in the Participant's profile and on the air ticket matches when receiving the air ticket or at the time of provision/registration of paid services.
3.1.4. Miles for a flight or service are credited to the Participant's Personal Account once and only within the framework of the Program.
3.1.5. If no Transactions are made on the Participant's Personal Account for more than 2 (two) years, the Airline has the right to terminate his/her participation in the Program by canceling the Personal Account number. In this case, such person retains the right to subsequently re-register as a Participant of the Program without restoring previously accumulated miles and taking into account the provisions of these Rules.
3.1.6. The Airline reserves the right to block or cancel the Personal Account of any Participant who has earned Miles in an unauthorized or fraudulent manner.
3.1.7. The Airline reserves the right to provide additional methods of earning and writing off Miles in addition to those specified in these Rules. The relevant information about all changes will be published on the Airline's Website.
3.2. Earning Miles when flying on regular flights of JSC ALROSA Airlines
3.2.1. When flying on regular flights of the Airline, the Participant is credited with Miles as a percentage of the actual distance in miles between the departure and arrival airports, depending on the brand, fare and class of service specified in the air ticket.
3.2.2. When a Participant flies on a route that includes Flight Segments of several air carriers (regardless of whether one ticket is issued for such Flight Segments or several), Miles are credited only for Flight Segments performed by JSC ALROSA Airlines.
3.2.3. When a Participant flies on Code Share Flights, Miles are not credited.
3.2.4. When traveling on tickets with an involuntary upgrade of the service class or any other upgrade of the service class not related to the Member paying the full difference between the economy class fare and the available business class fare, Miles are credited in accordance with the class and fare of the paid ticket.
3.2.5. When traveling on Award tickets on scheduled flights of the Airline, Miles are not credited.
3.2.6. Miles are not credited in the case of using certain booking classes; fares with industry discounts; special fares of the Airline, the terms of application of which stipulate that they do not participate in the accrual of Miles; charter flights; award flights; tickets and services for which Members receive bonuses under other incentive programs.
3.3. Crediting Miles to the Personal Account and restoring unrecorded Miles
3.3.1. For automatic crediting of Miles, the Participant must indicate their Personal Account number when booking/purchasing.
3.3.2. Miles are automatically credited to the Participants' Personal Account within 3 (three) business days after the flight, provided that the Participant's personal data on the ticket (Participant's full name and Personal Account number) matches the corresponding data specified in the Participant's registration form.
3.3.3. The Participant must independently check the status of their Personal Account, the correctness and number of Miles credited to it on the Airline's Website. If there is no information on the Personal Account for one of the flights taken, the Participant can request the restoration of unaccounted Miles using a special form in the personal account on the Airline's Website, in the "Diamond Mile" section.
3.3.4. To accrue unaccounted Miles for flights or to restore Miles not accrued due to technical or other reasons beyond the control of the Airline, the Participant must fill out the appropriate form in the Personal Account on the Airline's Website, indicating the route, travel date, flight number, ticket number and fare code at which the air ticket was issued. In this case, the period for crediting Miles may be up to 45 (forty-five) business days.
3.3.5. In case of discrepancies between the personal data in the Participant's ticket and the Participant's profile, Requests for accrual of miles are subject to rejection.
3.3.6. Requests for restoration of unaccounted miles are subject to rejection if incorrect flight data, ticket number, departure date and passenger data are sent when filling out the relevant form in the Participant's personal account.
3.3.7. Requests for restoration of unaccounted miles are accepted for consideration only for the Participant's own flights.
3.3.8. Requests for restoration of unaccounted Miles for flights on Airline flights are accepted for consideration within 3 (three) months from the date of the flight that gives the right to accrual of Miles.
3.4. Validity of Accrued Miles
3.4.1. All Miles accrued in the Program are valid for the year in which the flight was made or the service was received and the following 13 months. (the next full calendar year and one more month up to and including January 31).
3.4.2. To automatically extend the validity of miles for another 1 (one) calendar year, the Participant must take at least one regular flight of JSC ALROSA Airlines at fares participating in the accrual of Miles, or perform another transaction to accrue Miles within the framework of special promotions, the terms and validity of which are determined by the terms of the promotion.
3.4.3. All unused Miles are cancelled if, within 2 (two) calendar years, no regular flights of JSC ALROSA Airlines are registered on the Participant's account at rates participating in the accrual of Miles, or no Miles accrual transactions are made within the framework of special promotions, the terms and validity of which are determined by the terms of the promotion.
3.4.4. All Miles that expire are cancelled on February 1 of the new calendar year following the year in which the Miles expire.
3.5. Use of Accrued Miles
3.5.1. Miles can be used to receive Program Awards on scheduled flights of the Airline.
3.5.2. Miles cannot be transferred from the Personal Account of one Participant to the account of another Participant.
3.5.3. The list of Awards may be expanded in relation to that presented in the text of these Rules, information about such changes will be published on the Airline's Website.
3.5.4. The availability of an Award may depend on the type of Award, date, season and route. The Airline does not guarantee the possibility of receiving any Award at any time.
4 – Statuses and Privilege
4.1. Statuses
4.1.1. The temporary status is assigned to the Participant automatically after completing the registration in the Program and allows them to earn Miles when flying on regular flights of the Airline at fares participating in the accrual of Miles, and to use the accrued Miles to receive Awards.
4.1.2. The elite statuses are: "Silver", "Gold", "Diamond".
4.1.3. The Silver status is assigned to the Participant as a result of earning 10,000 Flight Miles or after taking 10 flights on regular flights of the Airline within 1 (one) calendar year at fares participating in the accrual of Miles in accordance with the rules for qualifying for Silver status, published in the "Diamond Mile" section of the Airline's website.
4.1.4. Gold status is awarded to a Member as a result of accruing 25,000 Miles or after completing 25 flights on the Airline’s scheduled flights within 1 (one) calendar year at fares participating in the accrual of Miles in accordance with the Gold status qualification rules published in the “Diamond Mile” section of the Airline’s website.
4.1.5. Diamond status is assigned to a Member as a result of accruing 40,000 Miles or after completing 40 flights on regular Airline flights within 1 (one) calendar year at fares participating in the accrual of Miles in accordance with the Diamond status qualification rules published in the Diamond Mile section of the Airline's website.
4.1.6. To extend the Status validity period for the next period, the Member must fulfill the conditions similar to the conditions required to achieve the Status within 1 (one) calendar year. If the conditions for accruing the required number of Flight Miles or accounting for Flight Segments are not met, the Member is transferred to one status lower on February 1 of the new calendar year following the year in which the status expires.
4.1.7. The corresponding Elite status is assigned to the Participant upon accrual of the required number of Miles to his Personal Account, regardless of how many Miles from the previously accrued ones were written off from his Personal Account.
4.1.8. Elite status is valid until the end of the calendar year in which the conditions for its assignment were met, and the following 13 months (the next full calendar year and one more month, up to and including January 31).
4.2. Privileges
4.2.1. Program Participants who have been assigned Elite status receive additional Privileges that are published on the Program Website.
4.2.2. Privileges for Participants with Elite status are available when flying on regular flights of the Airline at fares participating in the accrual of Miles, as well as on award air tickets.
4.2.3. To receive the Privileges provided for by Elite status, the Participant must include information about the Participant's Personal Card Number in the booking.
4.2.4. In the absence of a personal card number in the booking, the provision of privileges to Participants who have Elite status is not guaranteed by the Airline.
4.2.5. If the Participant has entered an incorrect Personal Card Number, and/or the personal data in the participant's profile does not match the personal data in the booking, the Participant will be denied the provision of privileges.
4.2.6. The Airline reserves the right to impose restrictions on the provision of Privileges, including restrictions on aircraft types, routes and dates of issuance of Privileges.
4.2.7. The "Additional status miles for flights" privilege is available to status Members if the Member's Personal card number is included in the booking: Silver status holders — in the amount of 5% of the miles accrued per flight; Gold status holders — in the amount of 10% of the miles accrued per flight; Diamond status holders — in the amount of 15% of the miles accrued per flight.
4.2.8. The "Free seat selection in the aircraft cabin" privilege is available to Silver, Gold and Diamond status holders during online check-in and only if the Member's Personal card number is included in the booking.
4.2.9. The "Free provision of an increased comfort seat" privilege is available to Gold and Diamond status holders during online check-in and only if the Member's Personal card number is included in the booking.
4.2.10. The "Additional baggage space up to 23 kg" privilege is available to Gold and Diamond status holders if the Member's Personal Card Number is present in the booking.
4.2.10.1. To apply for the "Additional baggage space up to 23 kg" award, the Member must send an application to the Program Service Center by e-mail: Diamondmile@aero.alrosa.ru.
4.2.10.2. Applications are processed daily on weekdays from 8:00 to 12:00 Moscow time, except weekends and holidays.
4.2.10.3. The application must be submitted no later than 2 business days before the flight departure. If the flight is operated on a day off or the day following a day off, the application period is 3 business days.
4.2.10.4. The Airline shall not be liable for failure to provide the privilege if the Member does not comply with paragraphs 4.2.10.1 – 4.2.10.3 of these Rules when registering.
4.2.11. The “Priority check-in at the airport” privilege is available to Diamond status holders if the Member’s Personal card number is included in the booking and if the departure airport has the technical capability.
4.2.12. The “Access to premium lounges” privilege is available to Diamond status holders only if the Member’s Personal card number is included in the booking. The list of airports where the Privilege is provided is published on the Airline’s Website.
5 – Issuing Awards
5.1. General Provisions 5.1.1. If the required number of Miles is available on the Personal Account, the Participant has the right to:
• Issue an Award ticket for an Airline flight;
• Issue other Awards stipulated by the Program Rules.
5.1.2. The number of Miles to be written off for issuing an Award is calculated based on the data on the routes provided in the Award table on the Airline’s Website, in the “Diamond Mile” section.
5.1.3. Program Participants make reservations and issue Awards in the manner stipulated by paragraph 5.2. of these Rules.
5.1.4. All Miles used to receive a specific Award must be written off from one Personal Account of the Program Participant. It is not permitted to pay for one Award with Miles from several accounts.
5.1.5. The Participant may register the Prize for himself or herself, as well as for any other person indicated by him.
5.1.6. Issued Awards cannot be re-issued to another person or transferred and/or assigned to another person.
5.1.7. Awards cannot be sold, purchased or exchanged for material assets or other Awards. In the event of the Award being used in such a manner, the Award may be cancelled, and the Participant who has performed the specified actions will be excluded from the Program.
5.1.8. The Airline, within the framework of the Program, reserves the right to request confirmation of identification of any person wishing to use the services of the Program and to refuse to provide services in the event that confirmation cannot be provided.
5.1.9. If the Participant is legally incapacitated or his/her legal capacity is limited, the application for the Award must be completed in accordance with the requirements of Articles 26, 27 and 28, Part 1 of the Civil Code of the Russian Federation. In this case, the Airline, within the framework of the Program, reserves the right to request additional documentation.
5.2. Premium air tickets on Airline flights
5.2.1. Award tickets for flights on the Airline’s regular flights can be issued in exchange for the corresponding number of Miles being debited from the Participant’s account in accordance with the Award table on the Airline’s Website in the “Diamond Mile” section. The number of Miles required to issue an Award ticket depends on the destination and class of service of the Award ticket.
5.2.2. Award tickets for flights on the Airline’s regular flights are issued for a one-way or round-trip route.
5.2.3. All Award tickets are issued in electronic form (E-ticket).
5.2.4. An Award ticket can be issued to any person specified by the Participant. The recipient of the ticket is always the Participant from whose Personal Account the Miles are debited. Miles are debited from the Participant’s account at the time of booking the Award ticket.
5.2.5. Booking and issuing of Premium air tickets is possible through the Airline's Website after authorization in the Participant's personal account or at the ticket offices of the Airline's authorized agents. Booking is subject to availability of seats at the rates intended for issuing premium tickets.
5.2.6. In the event of issuing a premium ticket by a Participant, the holder of Elite status, for any person specified by him, the privileges of the Participant from whose account the premium is issued do not apply to the holder of the premium.
5.2.7. The Airline reserves the right to request additional confirmation of the Participant's identification.
5.2.8. The Airline's Rules and Conditions of Air Carriage of Passengers apply to air transportation using an Award Ticket.
5.2.9. Taxes, service charges, and the processing fee cannot be paid with Miles. Fees can be paid using one of the methods specified on the Airline's Website and available at the time of the request.
5.2.10. In the event of a voluntary exchange of an Award Ticket, the terms and conditions for applying award fares published on the Airline's Website should be followed.
5.2.11. In the event of a voluntary refusal to travel using an Award Ticket, Taxes, service charges, and the processing fee may be refunded to the Participant. When carrying out the procedure for returning an Award Ticket, the terms and conditions for applying fares published on the Airline's Website should be followed.
5.2.12. In case of voluntary refusal to fly on an Award ticket, the Miles written off for the ticket are not refundable.
5.2.13. In case of forced refusal to fly on an Award ticket, the Miles written off for the ticket are refundable in full.
5.2.14. Award tickets for codeshare flights are not issued.
5.2.15. Award tickets for charter and custom flights are not issued.
5.2.16. The Airline reserves the right to impose restrictions on booking Awards, including restrictions on routes and dates of Award issuance.
5.3. Conditions of travel on an Award ticket in case of flight cancellation
5.3.1. In case of cancellation of the Airline's flight, passengers will be sent to the nearest available Airline's flight.
5.3.2. To return Miles in case of cancellation of the Airline's flight, the Participant must make a request via the feedback form on the Airline's Website or to the Program Service Center by e-mail Diamondmile@aero.alrosa.ru, to return unused Miles to his Program Participant account. In the request, the Participant must provide a brief description of what happened, attach a copy of the air ticket, a copy of the boarding pass (if check-in for the flight was completed) and submit the request within 30 (Thirty) days from the date of the flight cancellation.
Legal liability of the parties
6.1. Change, temporary suspension and cancellation of the Program 6.1.1. The Airline reserves the right to cancel or change the entire Program or part of it at any time, with or without prior notice. Such changes shall come into force after the relevant information is posted on the Program Website. In the event of cancellation of the Program, all Miles earned by Program Participants may be cancelled without compensation in cash. The Airline shall not be liable for any losses or damages incurred as a result of changes or cancellation of the Program.
6.1.2. The Airline, acting within the framework of the Program, reserves the right not to send informational materials on the Program to Participants who are not Active.
6.1.3. The route network and flight schedule of the Airline may change at any time. The Participant will be able to familiarize themselves with such changes on the Airline Website.
6.1.4. The Airline may change or exclude any fares, Awards or services from the Program. The Participant will be able to see such changes on the Airline's Website.
6.2. Termination of participation in the Program, disqualification or temporary removal of Participants
6.2.1. Voluntary termination of participation in the Program is possible upon personal application of the Participant to the Program Service Center by filling out an application in free form, accompanied by a copy of the identity document. After receiving the application from the Participant, his Personal Account is closed, accrued Miles and Status are cancelled.
6.2.2. The Airline reserves the right to exclude the Participant from the Program, withdraw the Participant's Card and cancel all Miles accrued to him in the event of a violation of the Rules and Conditions of the Program by the Participant. The basis for excluding the Participant, among other things, may be the publication by him (or on his behalf) in open Internet resources of an advertisement for the purchase/sale of Miles, air tickets both with and without the Airline logo.
6.2.3. If the Program Participant performs transactions with Miles or Awards (purchase, exchange, merge, steal) without the grounds provided for in these Rules, these Miles will be cancelled and the Awards will be revoked.
6.2.4. The Airline reserves the right to exclude the Participant, cancel the Elite status and all Miles accrued to him/her in the event of a violation of the rules and conditions of passenger transportation of the Airline, aviation security rules.
6.2.5. Persons selling or exchanging Awards, as well as persons who have purchased Miles or Awards, are responsible for the losses and expenses incurred by the company and are obliged to reimburse these expenses.
6.2.6. Program Participants are obliged to strictly comply with the Rules and conditions of the Program, as well as to observe all the terms described in the Program. The Participant must periodically review the Rules of this Program for changes made to them.
6.2.7. The Airline reserves the right to check the accounts of the Program Participants, temporarily suspend the account, and partially or completely restrict various Transactions.
6.2.8. The Airline reserves the right to use, at its own discretion, the Miles cancelled in accordance with paragraphs 6.2.1, 6.2.2, 6.2.3, 6.2.4 of these Rules.
6.3. Other
6.3.1. All relationships between the Airline and the Program Participants are governed by these Rules, the Airline's Rules for the Carriage of Passengers and Baggage, as well as the Air Carriage Agreement posted on the Airline's Website. In the part not regulated by the said regulatory documents and the Airline's Rules for the Carriage, the relationships between the Airline and the Program Participants are also governed by the applicable Russian Federation legislation, taking into account conflict of laws rules. In the event that the provisions of the Rules and regulatory documents of the Airline contradict the current legislation, the current legislation of the Russian Federation shall apply.
6.3.2. The place of consideration of possible disputes arising within the framework of the implementation of the Program is at the location of the Airline.
6.3.3. Unless otherwise provided by these Rules, disputes related to participation in the Program are resolved through the claims procedure.
6.3.4. Claims of Participants related to their participation in the Program shall be sent in writing to the Program Service Center.
6.3.5. Liability for damage caused to Participants when exercising their rights related to participation in the Program shall be governed by applicable norms of international law and relevant national legislation, as well as the Airline Rules.
